Terms and Conditions of Sale

These general conditions of sale (the "General Conditions") govern the terms and conditions under which Aldighieri Gioielli will provide the user with its branded products Aldighieri Gioielli available for sale online on the website https://www.aldighierigioielli.com. These General Conditions apply exclusively to the Products sold by Aldighieri Gioielli through the Site.

It is essential that the buyer carefully reads and understands these General Terms and Conditions of Sale before proceeding with the purchase of any Product on the Website. Each time the buyer decides to proceed with a purchase order, it will be necessary to confirm that they have read, understood, and accepted the terms and conditions outlined in these General Terms and Conditions of Sale. If the buyer does not accept these General Conditions of Sale, they will not be able to place purchase orders for the Products offered on the Website. It is highly recommended that the buyer print and keep a copy of this document for future reference.

THE USER
By placing a purchase order on the Site, the user declares that they:

a) are at least 18 years old; b) are an individual acting for non-professional purposes and purchasing the Product as a consumer (hereinafter the "User").

ENTERING DATA, ACCEPTANCE OF PRIVACY POLICY, AND CONCLUSION OF THE ONLINE SALES CONTRACT
3.1. To complete a purchase of Products on the Site, each User must provide the following data:

3.2. Before completing the purchase of a product, the User must read and accept the terms of the privacy policy (see art. 13 below) and give their consent to the processing of personal data.

3.3. Once the data is entered and the privacy policy terms are accepted, the User can proceed with the purchase of the Product(s).

3.4. The purchase order represents the User's intention to purchase the Product(s) indicated in the respective order. The purchase order will be considered issued upon the completion of the online purchase procedure in the appropriate section within the Site. After entering the purchase order, the User will receive a confirmation email acknowledging receipt of the order, indicating the order identification number and details of the ordered Product(s) (hereinafter "Order Summary").

3.5. Please note that the Order Summary is only a communication from Aldighieri Gioielli acknowledging receipt of the purchase order submitted by the User, and therefore, the purchase order is not yet considered accepted by Aldighieri Gioielli. All purchase orders for a Product will be subject to specific acceptance by Aldighieri Gioielli and will be considered accepted (and the online sales contract for the Product will be deemed concluded) when the User receives an email confirming the shipment of the Product (hereinafter "Shipping Confirmation").

3.6. With a single Order, a User can purchase one or more Products without quantity limits, subject to Product availability on the Site.

3.7 Aldighieri Gioielli reserves the right to refuse an order:

a) When the Product(s) are not available; b) If Aldighieri Gioielli does not receive authorization to charge the cost of the Product(s) to the User; c) If the User does not meet the eligibility criteria set out in the previous article 2; d) When a clearly incorrect price is indicated at the time of purchase and recognizable as such (prices too high or too low compared to the market average and without promotional claims).

3.8. Upon receiving the Shipping Confirmation, the online sales contract for the Product (the "Contract") will be deemed concluded and fully binding for the User and Aldighieri Gioielli (except in the case of a recognizable material error in the price as per art. 3.7). In such cases, Aldighieri Gioielli reserves the right to cancel the order and cancel the shipment. The User will be contacted by Aldighieri Gioielli to be informed and will receive a refund for the transaction carried out, in the same payment methods used by the User for the online purchase (see article 6 below).

3.9. Aldighieri Gioielli accepts purchase orders with territorial limits (for shipping and delivery methods, see article 5 below).

RIGHT OF WITHDRAWAL - RETURNS
4.1. Pursuant to art. 52 of Legislative Decree 206/2005 ("Consumer Code"), the User may withdraw from the Contract within 14 days from the date of delivery of the Product. To meet the withdrawal deadline, it is sufficient that the User follows the procedure outlined in point 4.3 below before the withdrawal period expires.

4.2. The User must take all appropriate measures to preserve the Product and do everything possible to ensure that the Product is returned in the best possible condition, including the undamaged original packaging, instruction manuals, any separate items, and any other component. The Product must not have been handled in a way other than necessary to establish the nature, characteristics, and functioning of the product. If the User complies with the measures outlined in this article 4.2, they will be entitled to a refund of the purchase price of the Product in accordance with the provisions below.

4.3. To withdraw from the Contract, the User must contact Aldighieri Gioielli at the following email address aldighierigioielli@gmail.com and explicitly state their decision to withdraw from the contract. The user will be informed about the procedures for returning the Product. The User is responsible for the integrity of the Product as long as it remains in their possession.

4.4. If the User decides to return the Product and provided that the right of withdrawal from the Contract has been exercised within the withdrawal period (so-called Cooling-Off Period) of 14 days, Aldighieri Gioielli will refund - using the same payment methods used by the User for the online purchase - all payments received from the User, without undue delay and, in any case, no later than 10 days from the day Aldighieri Gioielli physically received the Product(s) that the User communicated they intended to withdraw from the Contract. Aldighieri Gioielli will provide return instructions via email, and return costs will be charged to the User.

4.5. Aldighieri Gioielli will not consider return requests if the returned Product is found to be malfunctioning due to improper use, negligence, physical, aesthetic, or surface damage, tampering, or improper maintenance, or wear and tear, and will not consider return requests for Products other than those listed on the shipping document. The User is always responsible for the correct use of the Products purchased online.

4.6. The User cannot withdraw from the Contract if their purchase concerns Products made to measure or clearly personalized pursuant to art. 59, lett. c) of the Consumer Code.

4.7. If the User intends to have the size of a Product corrected after receiving it, they must contact Aldighieri Gioielli at the following email address aldighierigioielli@gmail.com within 7 days from delivery, indicating the new chosen size. Aldighieri Gioielli will promptly inform the User about the feasibility of the correction. If the correction is not possible, the User's right to withdraw remains unaffected as previously stated, unless the original case falls under art. 4.6 above. If the correction is possible, the User, at their own expense and care, must send Aldighieri Gioielli (to the address indicated in the confirmation email of the possibility of correction) the Product to be corrected. Once the correction is completed, Aldighieri Gioielli will inform the User via email, and the User must collect the corrected Product at their own expense and care. In addition to the shipping and collection costs for the product to be corrected/corrected, the User will also bear the costs for the correction, unless such corrections are attributable to errors or negligence by Aldighieri Gioielli. The correction request can be made only once, and the User acknowledges and accepts that the correction of the Product may involve slight modifications to the original geometry of the Product itself. Once the size of the Product is corrected, article 4.6 above will apply, and the Product will be considered made to measure or clearly personalized.

DELIVERY AND PASSAGE OF PRODUCT RISK
5.1. Aldighieri Gioielli will deliver the ordered Products both within the Italian national territory and outside it, within the borders of the European Union. Shipping is insured and always free regardless of the value of the purchased product.

5.2. The User will receive in the Shipping Confirmation email, from the courier appointed by Aldighieri Gioielli, the tracking number of the shipment and will be able to verify the shipping status of the purchased Product.

5.3. At the time of delivery of the Product, the presence of the User or an authorized third party to collect the Product by signing the related transport document will be necessary. If the Product has not been delivered within the terms indicated in the Shipping Confirmation email, the User can contact Aldighieri Gioielli at the email address aldighierigioielli@gmail.com or by phone at +393482266053.

5.4. The risk of loss and damage to the Product, for causes not attributable to Aldighieri Gioielli, transfers to the User when the Product is physically in the possession of the User or a third party authorized to collect the Product.

5.5 Aldighieri Gioielli is not responsible for any delivery delays if they are attributable to problems with the couriers used.

PRICE AND PAYMENT METHODS
6.1. The applicable prices for the Products are those indicated on the Site for each Product, except in the case of a recognizable material error as reported in art. 3.7 (prices too high or too low compared to the market average and without promotional claims). The prices of the Products are indicated inclusive of VAT updated to the current rate.

6.2. Aldighieri Gioielli reserves the right to change the price of the Products at any time. It is understood that any changes will not affect contracts already concluded before the modification.

6.3. Payment for Products purchased on the Site can only be made through Stripe, PayPal, and bank transfer.

LEGAL CONFORMITY WARRANTY ON PRODUCTS
7.1. The 18k gold Products purchased on the Site are covered by a legal conformity warranty of 24 months from the date of delivery pursuant to articles 128 and following of the Consumer Code. The conformity defect that manifests within 24 months from the purchase date of the good must be reported within 2 months following the date of discovery of the defect and, in any case, no later than 24 months from the product delivery date.

Loose gems purchased on the Aldighieri Gioielli site are not covered by a warranty, as their possible issues cannot be attributed to Aldighieri Gioielli.

7.2. Pursuant to art. 130 of the Consumer Code, in the event of a conformity defect of the Product, the User has the right to have the conformity of the good restored without expenses. For this purpose, the User can normally choose between repairing the Product or replacing it. This right of choice cannot be exercised only if the requested remedy is objectively impossible or excessively expensive compared to the other. Furthermore, the User has the right to an appropriate price reduction or contract termination only in the event of one of the following situations: i) repair and replacement are impossible or excessively expensive; ii) Aldighieri Gioielli has not provided for repair or replacement within a reasonable time; iii) replacement or repair has caused significant inconvenience to the consumer.

FORCE MAJEURE
8.1. Aldighieri Gioielli cannot be held responsible for the non-fulfillment or delayed fulfillment of its obligations here provided, due to circumstances beyond the reasonable and foreseeable control of Aldighieri Gioielli (hereinafter "Force Majeure Events").

8.2. Force Majeure Events include, by way of example and not exhaustive, the following circumstances:

a) strikes, lockouts, and other industrial disputes; b) civil mobilizations and insurrections, invasions, terrorist attacks or threats of terrorist attacks, armed conflicts (declared or not) or threats or preparation of conflicts; c) fires, explosions, storms, floods, earthquakes, or other natural disasters; d) inability to use public or private telecommunications means; e) pandemics or epidemics.

8.3. The fulfillment of obligations by Aldighieri Gioielli under these General Conditions will be suspended for the period in which the Force Majeure Events occur. Aldighieri Gioielli will do everything in its power to identify solutions that allow for the correct fulfillment of its obligations despite the persistence of Force Majeure Events.

WAIVER
9.1. The failure to request fulfillment of any of the provisions of these General Conditions will not affect the right of each party to demand fulfillment at any time thereafter, nor will the waiver of exercising a right resulting from a violation of these General Conditions constitute a waiver of exercising a right resulting from a subsequent violation of the same provision.

9.2. No waiver by either party of an article of these General Conditions will be effective unless expressly stated to be a waiver and communicated in writing.

INVALIDITY OF INDIVIDUAL CLAUSES
10.1. If any provision of these General Conditions is found to be illegal or invalid, it will not be considered part of the General Conditions, and this will not affect the remaining provisions which will continue to be valid to the maximum extent permitted by law.

MODIFICATION
11.1. Aldighieri Gioielli reserves the right to modify these General Conditions at any time, giving specific notice on the Site.

SITE
12.1. Aldighieri Gioielli will make every effort to ensure that the Site is available continuously 24 hours a day, but cannot be held responsible if, for any reason, the Site is not accessible and/or operational at any time or for any period. Access to the Site may be temporarily suspended without notice in the event of system failure, maintenance, repairs, or for reasons beyond Aldighieri Gioielli's control or due to Force Majeure Events.

PROTECTION OF PERSONAL DATA
Aldighieri Gioielli will process the personal data of Users as the data controller in compliance with the provisions of Regulation 2016/679/EU ("GDPR") and in compliance with the applicable national legislation on personal data protection. For more information regarding the processing of personal data, Users can consult the Privacy Policy available on the Site.

APPLICABLE LAW AND JURISDICTION
14.1. These General Conditions and the individual Contracts governed by them are exclusively regulated by the current Italian law.

14.2. For any dispute that may arise between Aldighieri Gioielli and the User concerning the General Conditions and/or the individual Contracts, the competent court will be the one of the User's residence or elected domicile.
